DHS warns Dem governor’s ICE law plays ‘Russian Roulette’ with American lives

The Department of Homeland Security told Fox News Digital that US Immigration and Customs Enforcement Police have arrested Felberto Gonzalez Gutierrez, a criminal illegal alien from Mexico, and charged him with attempted murder, assault and reckless endangerment in Anne Arundel County, Maryland.

maryland local outlet, Al Asimah newspaperIt was reported that Gutierrez slit his wife’s neck with a box cutter and accused her of cheating on him.

After the crime and subsequent arrest, the Department of Homeland Security said an ICE detainer housed at the Anne Arundel County Detention Center was honorably discharged, “allowing for a safe and controlled transfer of custody.” Gutierrez is currently in ICE custody awaiting deportation proceedings, according to the Department of Homeland Security.

“Safe detentions like these are now in jeopardy with politicians in the Maryland Legislature passing a bill prohibiting cooperation with ICE,” the agency said.

The bill, signed by Democratic Gov. Wes Moore on Tuesday, bars state and local jurisdictions in Maryland from partnering with ICE in immigration enforcement operations through what is known as the 287(g) program. The bill was signed into law as part of emergency legislation, taking effect immediately and requiring any local jurisdictions that have standing agreements under Section 287(g) to immediately terminate them.

The bill does not prevent local law enforcement from honoring ICE detainees, which is up to the local agency’s discretion under Maryland law. However, by prohibiting partnerships under Section 287(g), local law enforcement agencies are prohibited from issuing their own immigration detainers.

Ammar Moussa, a spokesman for Moore’s office, responded to the Department of Homeland Security by telling Fox News Digital: “There is nothing in today’s legislation that prevents the deportation of criminals.”

A statement issued Tuesday by Moore’s office said the legislation does not authorize the release of criminals, affect state policies and practices in response to DHS immigration detainers, prevent state or local jurisdictions from working with the federal government on the removal of violent criminals who pose a risk to public safety or prevent state or local jurisdictions from continuing to notify ICE of the impending release of an individual of interest from custody or from coordinating a safe transfer to custody within constitutional limits.

In the same statement, Moore criticized federal immigration agents, saying, “In Maryland, we stand for constitutional rights and constitutional policing — and we will not allow untrained, unqualified, and unaccountable ICE agents to mandate our law enforcement officers.”

“This bill draws a clear line: We will continue to work with federal partners to hold violent crime perpetrators accountable, but we refuse to blur the lines between state and federal authority in ways that undermine trust between law enforcement and the communities they serve,” Moore said.

“Maryland is a community of immigrants, and that is one of our greatest strengths because this country is incomplete without every one of us,” Moore added.

However, Assistant Secretary of Homeland Security Tricia McLaughlin, who is set to leave the Department of Homeland Security next week, told Fox News Digital that the Maryland legislature is “unfortunately following a dangerous path…of putting criminal illegal aliens ahead of American citizens.”

“Filberto Gonzalez Gutierrez, the monster who cut his wife’s throat with a cutter, will never walk the streets of America again because Anne Arundel County worked with Immigration and Customs Enforcement to keep this criminal off our streets,” McLaughlin continued.

“Now, Maryland sanctuary politicians are playing Russian roulette with American lives by banning cooperation with ICE and forcing law enforcement to release criminals from their prisons into our communities, committing more crimes and creating more victims.”

In addition to Gutierrez, the Department of Homeland Security accused Maryland politicians of “choosing to protect” other “threats to public safety” recently arrested by Immigration and Customs Enforcement in Maryland.

The agency noted the recent arrests by Immigration and Customs Enforcement of Vladimir Herrera Garcia, from El Salvador, who was convicted of murder and robbery; Manuel Portillo Cardoza, from El Salvador, was convicted of assault and lewd or lascivious acts with a minor; José Rivera Medrano, of El Salvador, was convicted of incest with a minor, pedophilia, and another sex offense; Nilo Herrera Sanchez, from Peru, was convicted of rape by force of the arm, sexual assault, sexual offense, and rape with a weapon; Jeffrey Alfaro Lemos, an MS-13 member from El Salvador, was convicted of gun possession.

“By prohibiting cooperation with ICE, Maryland’s sanctuary policies side with criminal illegal aliens over public safety,” the Department of Homeland Security stated. “Unfortunately, the only result will be continued murder, rape, assault, robbery, and the slaughter of American lives,” McLaughlin added.
